The rules of engagement.

1. Scope
These terms apply to all services and contracts from Jr's Harvesting Inc. (218 Main Street, Eureka, SD 57437). Booking a service, signing a contract, or accepting a quote constitutes agreement to these terms. The specific scope, rate, and timing of each job are set out in the written contract or quote.
2. Booking & scheduling
Jobs are booked by mutual agreement of field location, crop, acreage, expected start date, and rate. We confirm bookings in writing (email or signed quote). Verbal agreements are followed by written confirmation within 48 hours.
Start dates are estimates. Weather, crop moisture, equipment issues, and prior-job overruns can move the schedule. We notify customers of any meaningful delay the same day we become aware of it.
3. Customer responsibilities
The customer is responsible for:
- Providing accurate field boundaries, access notes, and any GPS shapefiles.
- Ensuring the field is ready to combine (no standing water, no unreported hazards).
- Identifying overhead lines, tile lines, buried utilities, and other obstacles before the crew arrives.
- Marking field boundaries clearly when there's no fence or GPS reference.
- Arranging grain storage or trucking destination before the crew starts combining.
Damage caused by unreported obstacles is the customer's responsibility.
4. Pricing & payment
Rates are quoted per acre (combining, tillage, planting) or per load (hauling). Full-season contracts get a discounted blended rate. Quotes are written, with no fuel surcharges added mid-season.
Payment terms: due net 30 days from invoice for established accounts; COD or pre-payment for first-time customers and rush jobs. Accepted methods: check, ACH/wire transfer, and major credit cards (2.5% processing fee).
Late payments accrue interest at 1.5% per month (18% APR). Accounts over 60 days past due may be turned over to collections; legal fees are the customer's responsibility.
5. Cancellations
Customer cancellations:
- 14+ days before start date: free cancellation.
- 7–14 days before: 10% of the contracted value.
- Less than 7 days before: 25% of the contracted value.
- After we've arrived on site: full contracted value.
Our cancellations: free, except for documented non-recoverable mobilization costs in specific cases. We refund any advance payment not yet earned.
6. Weather
Wet days do not incur charges. We stop when the crop is too wet or the field is unfit and return when conditions allow. The contract's total acreage and value are unaffected by weather days; they simply shift the timeline.
If a season is so compromised by weather that completing the job is no longer commercially sensible for either party, either side can terminate the contract with 7 days' written notice. We refund any advance payment not yet earned.
7. Liability & insurance
Jr's Harvesting Inc. carries commercial general liability ($2M aggregate), workers' compensation for all crew members, and equipment coverage on every machine. Certificate of insurance provided with every contract.
Our liability for any single incident is limited to the value of the contracted service for that job. We are not liable for consequential losses (lost crop value, lost planting window, lost opportunity). Where state law provides stronger protections, those prevail.
Customers are responsible for insuring standing crop and harvested grain. We are not liable for loss or damage to crop caused by equipment failure, weather, or any cause beyond our reasonable control once grain leaves the combine.
8. Subcontracting
We do not subcontract without written approval. Where approved, the subcontractor operates under our insurance and our contract terms.
9. Disputes
We aim to resolve any disagreement directly. If we can't, disputes are subject to mediation in Eureka, South Dakota, before any litigation. Mediation costs are split equally; each party bears its own legal fees.
10. Governing law
These terms are governed by the laws of the State of South Dakota. Jurisdiction: courts of McPherson County, South Dakota.
Specific contract terms supersede these general terms where they conflict.
